Derek Chauvin’s Murder Conviction Against George Floyd Has Been Challenged In Court

Derek Chauvin’s counsel petitioned an appeals court on Wednesday to overturn the former Minneapolis police officer’s convictions in the killing of George Floyd, claiming that he was denied a fair trial due to procedural and legal flaws.

William Mohrman, the defence attorney for Chauvin, argued before a three-judge panel of the Minnesota Court of Appeals that the trial judge erred by not relocating the case from Minneapolis due to the intense pre-trial media coverage and the unprecedented security measures necessary due to protest fears.

The main question on appeal, according to Mohrman, is whether a criminal defendant can receive a fair trial in accordance with constitutional requirements in a courthouse surrounded by concrete blocks, barbed wire, two armoured personnel carriers, and a squad of National Guard troops, all of whom are present in case the jury finds the defendant not guilty.

Following the verdict of the jury that found Chauvin guilty of second-degree murder, third-degree murder, and second-degree manslaughter, Hennepin County Judge Peter Cahill sentenced Chauvin to 22 1/2 years. Later, Chauvin entered a guilty plea to a different federal civil rights charge and was given a 21-year federal prison sentence, which he is currently serving in Arizona along with his state sentence.
